Employment Discrimination Based On Disability

by | Jul 8, 2016 | Law

People have to be able to find a job and work in order to make a living and take care of themselves and their families. Just because a person suffers from some physical, mental, or emotional need does not mean they do not have this same basic need. Someone with depression, a missing leg, or fibromyalgia still has to be able to work at a fair wage job just like anyone else. That is why there are laws and regulations set in place to ensure people with disabilities have the same chances as everyone else to get a good job and this is also why New Yorkers need a Disability Lawyer in Manhattan or whatever city they live in.

To discriminate against someone in the workplace is to treat that person different. Discrimination can occur in any working environment and in market or industry so long as there are people involved. Acts of discrimination that can occur in the workplace include unfair treatment; sexual or verbal harassment; improper questions about personal details; no protection of private information and medical records; giving unfair disadvantage in the workplace competition arena because of their disability; engaging in pay cut simply because the employee is disabled; or retaliation against an employee for filing a complaint. However, if the disability is easily corrected, such as using glasses or a hearing aid, it is not a protected disability and is not considered a condition for a discrimination case.

The Americans with Disability Act (ADA) prohibits employers from discriminating against employees with disabilities. The ADA protects all employees who have any type or severity of disability. It prohibits any employer form looking at the disability and seeing the employee in a negative light simply because of the disability. The ADA covers any and all physical and mental impairments and a Disability Lawyer in Manhattan will work to ensure the law is upheld and disabled employees are protected!
